These terms are an agreement between you and [Operator legal name] ("we", "us") for your use of Pointsflare, including the app, the website and our emails and notifications. By using Pointsflare you agree to them. If you do not agree, please do not use it.
The Beta
Pointsflare is in a private, invite only beta. It is free during the beta. Features may change, pause or stop, and we may end the beta at any time. You must be 18 or older and live in the United States to use it.
What Pointsflare Does
Pointsflare reads public points and miles posts and offer pages, pulls out the details of each deal, estimates what it is worth using point values, ranks deals for the cards you tell us you hold, and alerts you.
Pointsflare is information, not advice. Deals come from third parties and can change, sell out, be targeted to some cardholders only, or end without notice. Point values, grades and "worth about" figures are our estimates, not guarantees. Always check the live terms with the card issuer, merchant or program before you buy, sign up or travel. We are not a bank, a card issuer, or a financial, tax or legal adviser, and we are not affiliated with or endorsed by the issuers, programs, merchants or blogs we mention. Their names and logos belong to them and are used only to identify their offers.
Your Account
Keep access to your email account secure, because it is how you sign in. You are responsible for what happens under your account. Tell us at [Contact email] if you think someone else has used it. You can delete your account at any time in Settings.
Acceptable Use
Do not:
- copy, scrape or resell Pointsflare's deal feed, or use it to build a competing service;
- try to get into other people's accounts or data, or get around invite, rate or security limits;
- overload, probe or disrupt the service, or use it to break any law or anyone's terms;
- share your account, or misrepresent who you are.
We may suspend or close accounts that break these terms.
Links and Sources
Deals link to the blogs and sites where they were found. Those sites have their own terms and privacy practices, and we are not responsible for them. Links may carry a tag showing the visit came from Pointsflare. We may in the future earn a commission from some links; if we do, we will say so clearly.
Our Content
Pointsflare's software, design, rankings and text belong to us or our licensors. We give you a personal, non transferable right to use Pointsflare for your own non commercial purposes while these terms apply.
Feedback
If you send ideas or feedback, we may use them without owing you anything.
Disclaimers
Pointsflare is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including accuracy, fitness for a particular purpose and non infringement. We do not promise that deals are accurate, complete, current or still available, or that alerts arrive on time or at all.
Limit of Liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost points, miles, money, profits or opportunities, arising from your use of Pointsflare or any deal it shows. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim, or $50. Some places do not allow these limits, so they may not all apply to you.
Indemnity
If you use Pointsflare in breach of these terms or the law and someone makes a claim against us because of it, you agree to cover our reasonable costs of that claim.
Changes and Ending
We may change these terms. If a change matters, we will tell you in the app or by email before it takes effect; continuing to use Pointsflare after that means you accept it. You may stop using Pointsflare and delete your account at any time. We may suspend or end the service or your access, with notice where we reasonably can.
Governing Law
These terms are governed by the laws of [Governing state], without regard to its conflict of law rules. Disputes will be heard in the state or federal courts located in [Governing county and state], and you and we agree to their jurisdiction.
